Flight Canceled Due to Strike? Know Your Rights and Get Compensated

Have you had your flight canceled because of a strike—whether by airport staff, airline crew, or another service? Even if the strike was not the airline’s fault, you may be entitled to compensation.

 

A recent case in Brazil proves this. The São Paulo Court of Justice ruled against LATAM Airlines, ordering them to pay moral damages to a passenger whose flight from Argentina was canceled due to a national strike. The court found the airline failed to notify the passenger properly or offer alternative solutions.

 


What are your air passenger rights?


Airlines are required to assist passengers, even in unforeseen circumstances like a strike. Here’s what you’re entitled to:

 

  • Full ticket refund or rebooking on another flight at no cost;

  • Meal vouchers, hotel accommodation, and transportation during the wait;

  • Compensation for emotional or moral distress, depending on the case.



Airlines must still take responsibility


Even if external causes are involved, such as a strike or technical issues, airlines remain responsible for passenger care. They cannot abandon you.

 


Steps to take after a flight cancellation:


  • Keep all documents: emails, tickets, receipts, and expenses.

  • Request immediate assistance from the airline.

  • File complaints with aviation authorities or consumer protection agencies.

  • Speak with a lawyer who understands air passenger rights.
