INSS Fraud: Understand Your Rights and How to Protect Your Benefit

Recently, a police operation uncovered a fraud scheme worth more than R$6 billion within the INSS (Instituto Nacional do Seguro Social, Brazil's National Social Security Institute). The investigation found that public servants, lawyers, and intermediaries created fake benefits using forged documents.

As a result, the INSS began reviewing thousands of cases. Legitimate benefits such as retirement pensions, survivor's pensions, sickness benefits (auxílio-doença), and BPC (Benefício de Prestação Continuada, a continuous cash assistance benefit for low-income elderly or disabled individuals) are being suspended or preventively blocked.

If you are a beneficiary and depend on your benefit to survive, pay attention: you have rights and you can defend yourself!

What happened?

The fraud scheme involved:

Use of forged documents (ID cards, CPF/taxpayer ID, certificates);

Registration of fake employment relationships in the system;

Granting of benefits to people who were not actually entitled to them.

Now, in order to "fix the system," the INSS has launched mass reviews. However, this also affects people who obtained their benefits honestly.

How do I know if my benefit has been affected?

You may be asked to:

Submit documents;

Appear in person at an INSS office;

Respond to notifications received by mail or email.

If you fail to respond within the deadline, your benefit may be cut off.

Important: Even if you receive a notice, it does not mean you did anything wrong. In many cases, it is simply a routine check.

What should I do if my benefit is cut off?

If the INSS has suspended or canceled your benefit, you can and should defend yourself:

Seek out a specialized lawyer immediately.

Gather all documents that prove your entitlement (ID card, CPF, work record book, medical reports, certificates).

Request a copy of the administrative case file to understand the reason for the cutoff.

Present your administrative defense.

If the INSS does not resolve the issue, file a lawsuit to have the payment reinstated.

What are your rights?

Every INSS beneficiary has the right to:

Be notified in advance of any suspension or cancellation;

Access the case file and the documents that support the decision;

A deadline to present a defense;

Appeal the administrative decision;

File a lawsuit to secure the benefit.

Attention: If the INSS cancels a benefit without giving the beneficiary a chance to defend themselves, the action is illegal. You can have this decision reversed.

Who needs to be extra careful?

Those receiving retirement pension based on contribution time;

Those receiving a survivor's pension;

Those receiving sickness benefits or disability retirement;

Those receiving BPC/LOAS (assistance benefit for elderly people or people with disabilities).

These benefits are among the most heavily reviewed.

The INSS is conducting mass benefit reviews to combat fraud. However, in this process, many honest beneficiaries are being harmed.

If you have been notified, or if your benefit was suspended or canceled, don't panic. You have the right to defend yourself and can recover what is rightfully yours.
